AVENUE CYCLE HIRE - TERMS AND CONDITIONS
Bicycles and equipment hired on a rental agreement remain the property of Avenue Cycle Hire, Sark.
Avenue Cycle Hire, Sark and its employees shall not be responsible for personal injuries or property damage, loss or delay incurred by any person arising out of any act of negligence; nor shall Avenue Cycle Hire be responsible for any injuries, death, damage, loss or delay in any means of transportation or by reasons of any event beyond the reasonable control of Avenue Cycle Hire. Hirers follow any suggested itinerary at their own risk and agree not to hold Avenue Cycle Hire responsible for injury or death resulting from accidents. We advise that you do not ride without personal and third party liability insurance. Do not ride under the influence of alcohol, drugs, or heavy medication.
We strongly advise that the hirer should always ride with a helmet. Adults are responsible for ensuring children wear helmets. Bikes must not be ridden on the beach, cliff paths, La Coupee, Harbour hill or taken off of the island. Doing so will incur a £30 fine. Be courteous to pedestrians and other road users. Ride responsibly: do not attempt any manoeuvres beyond your skill level or the bike’s specific capabilities. It is your responsibility to ensure that you do not violate any local laws and cycle where cycling is permitted only. Anyone cycling in a discourteous or unsafe manner will have the equipment repossessed with no refund of hire charges.
The bicycles provided for use are in good operating condition and hirers agree to use them at their own risk or call deficiencies to the attention of a company representative. The hirer must inspect the bicycle before accepting it for any damage or defects. Acceptance of the bicycle is acceptance that it is in good roadworthy condition. You are responsible to set up the bike seat and height into a safe cycling position but you must not adjust or change anything else on the bike without permission from Avenue Cycle Hire.
Avenue Cycle Hire is responsible for structural deficiencies such as damaged frames, worn bottom brackets, suspension and wheel hubs. Avenue Cycle Hire is not responsible for the following occurrences during bike rental: gear tune ups / punctures / broken spokes / broken chains / broken derailleurs / broken drop-outs / wheel rim damage / torn saddles / damage beyond the control of Avenue Cycle Hire and resultant of hirer use or misuse. In the event of a mechanical failure, other than punctures, where the hirer is unable to return the bicycle to the shop please secure the bicycle and contact the shop on +44 (0) 1481 832102.
Hirer agrees he/she will return the equipment in the same good condition as when received, ordinary wear and tear accepted, and to repair and replace lost or stolen, damaged or broken bicycles or parts or to reimburse Avenue Cycle Hire for said equipment. Therefore regardless of the party at fault, hirer understands and agrees to be responsible for the theft or damage to said equipment. You are responsible for the security of the bicycle/rental and must lock it to a fixed object whenever unattended. The method of securing should include the front wheel and the frame, failure to do so could result in the theft of the bicycle which the hirer will be responsible for. The hirer must not change the code on the bike lock either intentionally or by accident. Should this occur and Avenue Cycle Hire has to cut the lock off, the hirer agrees they are responsible for the cost of a new lock.
Cancellations received 30 days or more before your start date will receive a full refund of any monies paid to date. Cancellations received less than 30 days before your start date are not eligible for refund. Rentals ending before the end date are not eligible for refund. All applicable refunds will be issued upon return of all rented equipment which must be within business hours (8-5:30) and accepted by a member of staff.
The total cost of hire is to be paid before the period of hire commences. We reserve the right to take the hirer’s credit/debit card details and deposit to hold as security until the equipment is returned subject to the following terms. The details/deposit is to be held against any loss, theft, damage or failure to return the equipment by the specified time and date. An additional day’s rental fee will be charged for each day the hirer keeps equipment after the return date specified on this contract, and we reserve the right to charge the hirers for the full cost of the equipment and any loss incurred within a 1 week period. All equipment must be returned directly to Avenue Cycle Hire, Sark. You shall pay any such costs in excess of the deposit.
